Shipping terms
General trading conditions (AGB) for the non-commercial course of business Conditions as of January 2010
Prices:
All prices are quoted in euros, inclusive 19% VAT, exclusive postage and packaging. The indicated prices are prices for private customers, including any deductions, the manufacturers might have offered for dealers / retailers.
Orders:
Orders are accepted in written format by fax or online by email. For the placed order, as well as further orders, these terms of delivery and sales are binding and come into effect by the time of placing the order. The shipment will be executed by freight post office or parcel service. The mode of shipment is left to the choice of Masters of Military. We select the most advantageous shipping mode for our customers. If our customers suggest a favourite shipping forwarder, we will take this into consideration
Contract:
The contract becomes legally effective with the shipment of the ordered items, not before. Masters of Military reserves the right to correct the price in case of errors, with prior consultation with the customer.
Shipments within Germany:
Purchase order value up to 10 EUR: 2.20 EUR freight
Purchase order value up to 50 EUR: 4.50 EUR freight
Purchase order value up to 100 EUR: 4.00 EUR freight
Purchase order value up to 150 EUR: 2.00 EUR freight
Purchase order value of 150 EUR and more: freight is free of charge
Cash on delivery package (COD) freight services: Package price plus COD fee 9.00 EUR, only available in Germany.
Shipments within the EU:
Purchase order value up to 10 EUR: 4.50 EUR freight
Purchase order value up to 50 EUR: 8.60 EUR freight
Purchase order value up to 100 EUR: 7.00 EUR freight
Purchase order value up to 150 EUR: 4.00 EUR freight
Purchase order value up to 200 EUR: 2.00 EUR freight
Purchase order value of 200 EUR and more: freight is free of charge.
Masters of Military does not provide a subsequent delivery for items that are not in stock.
Payment:
As for shipments within Germany, the payment should be executed by COD, by bank transfer or by cheque. In case of longer customer relationship payment on account is possible.
As for shipments in countries outside Germany payment via bank transfer or cheque is accepted. Any charges that might occur in this context have to be paid by the customer.

We reserve ourselves the property of the commodity up to the complete payment and reconciliation of all demands from the supply contract, supplied by us.
Guarantee/warranty:
All distinguishable defects should be immediately notified in written format to Masters of Military, not later than within eight days. Apart from that, the legal warranty deed is valid. All warranty claims are limited to rectification of defects or subsequent delivery of our choice. Should this be impossible, the customer has the right to withdraw from the contract. Additional claims can be exercised only in case of gross negligence. Any agreements shall be confirmed in writing to be legally binding.

In the event of a valid revocation of this agreement each party shall return to the respective other party the benefits received. In case, the customer is unable to reimburse the provider, in total or partially for services received, he is required to offer compensation of equal value to Masters of Military. As an exception from this the customer will not be held responsible of any replacement upon deterioration that is caused by a normal product check, which is common practice in e.g. a retail store.
In addition the reimbursement can be avoided by sending the commodity back in their original packaging, by not assuming ownership and making use of the goods and above that, by avoiding everything that could affect the value of the commodity.
The customer shall pay the return in any case. This does not apply if the shipped commodity does not correspond with the items ordered by the customer.
Obligations for the reimbursement of payments must be fulfilled by the customer within 30 days after sending off of the declaration of revocation.

Place of fulfilment and jurisdiction:
Place of fulfilment and jurisdiction for shipments and payments as well as place of jurisdiction for any disputes arising, including any legal disputes regarding bills-of-exchange and cheques, is Bad Oldesloe, Germany. It applies exclusively the right of Germany.
Masters of Military reserves the right to file suit at a court having jurisdiction at the place of residence of customers residing outside Germany.
Final clauses :
In the event that one or several of the above provisions is or becomes invalid, the validity of the remaining provisions shall not be affected. Invalid provisions shall be replaced by such provisions which are valid and come closest to the commercial purpose intended by the parties. Changes or additions of these general trading conditions require a written form.
